Maryland is on the forefront of climate action with the introduction of their own Building Energy Performance Standard (BEPS) policy, a pivotal component of the State’s Climate Solutions Now Act of 2022. This legislation is a significant step towards a sustainable future, aiming to reduce greenhouse gas emissions and improve energy efficiency across the state's building sector.
Maryland’s BEPS targets commercial, industrial, and multifamily buildings larger than 35,000 square feet, setting a clear path for energy performance improvements.
Annual benchmarking of energy use data will be required beginning in 2025. The reporting deadline is June 1st of each year, and third-party verification will be required every five years, starting in 2026 (reviewing 2025 data). This verification must be performed by a Professional Engineer (PE), a Licensed Architect issued within the United States, a Certified Energy Manager (CEM), or other Building Energy Assessment Professional deemed qualified by the State.
Compliance is required by 2030 and will be tracked by the Net Direct GHG Emissions Standard and site-level energy use intensity (EUI).
Net Direct GHG Emissions Standard
Interim targets are set for 2030 and 2035, with a final target by 2040. This standard is measured in kilograms (Kg) of CO2e per square foot.
Site Energy Use Intensity (EUI)
While there are no interim targets, the final target must be met by 2040. EUI is measured by kBTU per square foot.
For buildings unable to meet the standards, an alternative compliance path is available, including a fine structure starting at $230 per metric ton of excess CO2e in 2030, increasing annually to $270 per metric ton by 2040.
Building owners are encouraged to start benchmarking using EPA’s ENERGY STAR Portfolio Manager tool and invest in "no regrets" efficiency measures such as LED lighting, ENERGY STAR-certified equipment, and weatherization improvements.
